Terms of Service
Last updated October 24, 2026
These Terms of Service (“Terms”) are a legally binding agreement between you and Dr. Jesse Morse, MD and his professional practice (“we,” “us,” or “our”). They govern your access to and use of this website and its content (the “Site”). By accessing or using the Site, or by submitting an inquiry through it, you agree to these Terms. If you do not agree, do not use the Site.
PLEASE READ THESE TERMS CAREFULLY. They include a binding arbitration agreement, a class action waiver, and a jury trial waiver that affect how disputes are resolved (see Dispute resolution). They also disclaim warranties and limit our liability. These Terms govern the Site only. They do not govern medical care, which is covered by separate patient agreements.
Definitions
“Morse Parties” means Dr. Jesse Morse, his professional practice and any affiliated entities, and their respective owners, officers, employees, contractors, agents, licensors, successors, and assigns. “Content” means all text, images, graphics, logos, video, audio, schedules, and other material on the Site. “Including” means “including without limitation.”
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of an organization, you represent that you are authorized to accept these Terms for it, and “you” includes that organization.
Not medical advice; no physician–patient relationship
The Site and its Content are for general informational and educational purposes only and are not medical advice, diagnosis, or treatment. Content is not a substitute for an individual evaluation by a qualified healthcare professional. No physician–patient relationship is created by your use of the Site, by any email, call, inquiry, or message you send, or by any interaction with Dr. Morse on social media, in a video or podcast, or at a conference or event. Our Medical Disclaimer is part of these Terms.
Medical emergencies
If you think you may be having a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site, email, or social media for urgent medical needs. Messages sent through the Site are not monitored continuously, and we are not responsible for delays in responding to them.
Appointments and clinical services
- A physician–patient relationship begins only after you have completed our intake process and been evaluated by Dr. Morse. Clinical services are governed exclusively by our separate patient intake documents, informed consent forms, financial policies, and Notice of Privacy Practices (“Patient Agreements”). If these Terms conflict with a Patient Agreement, the Patient Agreement controls.
- Dr. Morse provides clinical care, including virtual consultations, only where he is licensed or otherwise legally authorized, which may depend on where you are physically located at the time of the visit.
- We may decline to schedule or provide any service to the extent permitted by law. Information on the Site about services, availability, and pricing may change without notice and is not an offer to provide care.
- Florida law requires the consent of all parties to record a private conversation. You may not record any call, visit, or virtual consultation without our express prior consent.
Speaking, media, and consulting
- Submitting a booking or consulting inquiry does not create an agreement, reservation, or obligation of any kind. An engagement is binding only when it is set out in a written agreement signed by us.
- Inquiries are not confidential unless we agree otherwise in writing. Please do not send confidential or proprietary information through the Site.
- Consulting services are educational and advisory only. They are not medical care for any patient, and they are not legal, regulatory, billing, or compliance advice. Each organization remains solely responsible for its own clinical decisions, protocols, staff supervision, and compliance with applicable law.
- The conference schedule on our Media page is provided for convenience only and may be incomplete or change without notice. Events are organized by third parties, and the Morse Parties are not responsible for their organization, content, cancellation, or conduct.
Peptavo and educational programs
Peptavo and other educational programs offered by or with Dr. Morse are governed by their own terms, which control for those programs. Educational content for clinicians does not replace independent clinical judgment. Each clinician is solely responsible for evaluating and treating their own patients and for practicing within their license, scope of practice, and applicable federal and state law.
Intellectual property
The Site and its Content are owned by the Morse Parties or their licensors and are protected by U.S. and international copyright, trademark, and other laws. All rights not expressly granted are reserved. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Site and print individual pages for your own non-commercial use.
Without our prior written permission, you may not:
- copy, reproduce, modify, distribute, publish, sell, license, or create derivative works from any Content;
- use Dr. Morse's name, image, voice, likeness, signature, or logos for any commercial or promotional purpose, or in any way that suggests his endorsement or affiliation (see also Florida Statutes section 540.08); or
- record, rebroadcast, or redistribute Dr. Morse's presentations, lectures, slides, or other materials, except as permitted in a written agreement with us.
Acceptable use
You agree not to:
- use the Site for any unlawful, fraudulent, or harmful purpose;
- submit false, misleading, or spam inquiries, or impersonate any person or misrepresent your affiliation;
- upload or transmit malware or any content that is abusive, defamatory, harassing, obscene, or infringes anyone's rights;
- attempt to gain unauthorized access to the Site or related systems, probe or test their vulnerability, or interfere with or disrupt the Site;
- scrape, crawl, data-mine, or harvest Content or contact information by automated means;
- use any Content to train, fine-tune, or develop artificial intelligence or machine-learning models;
- frame or mirror the Site, or reverse engineer any part of it; or
- use the Site to send unsolicited advertising or promotions.
Information you send us
- You are solely responsible for what you send us, and you represent that it is accurate, lawful, and yours to share.
- Do not send medical information through the Site. We have no obligation to review, act on, or respond to unsolicited medical information, and sending it does not create a physician–patient relationship.
- If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without compensation or attribution to you, and we have no duty to keep them confidential.
- We are not obligated to respond to any inquiry. How we handle your information is described in our Privacy Policy, which is part of these Terms.
Electronic communications
By using the Site or emailing us, you consent to receive communications from us electronically and agree that electronic communications satisfy any legal requirement that a communication be in writing. Standard email is not encrypted. If you choose to communicate with us by email, you accept the risk that it may be intercepted or read by others.
Third-party links and services
The Site links to third-party websites and services, such as LinkedIn, YouTube, X, and conference organizers. The Morse Parties do not control and are not responsible for their content, accuracy, availability, policies, or practices. A link does not mean we endorse the site or its content. Your use of any third-party site is at your own risk and subject to its terms.
Disclaimer of warranties
YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE MORSE PARTIES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND TIMELINESS, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
THE MORSE PARTIES DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT IS CURRENT OR RELIABLE. NO ADVICE OR INFORMATION OBTAINED FROM THE SITE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE MORSE PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SITE, THE CONTENT, OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE MORSE PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE CONTENT, OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
These limitations are an essential part of the bargain between you and us and apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law, and they do not apply to professional medical services, which are governed by applicable law and our Patient Agreements.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Morse Parties from and against all claims, demands, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to (a) your use or misuse of the Site, (b) anything you submit to us, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.
Dispute resolution
Please read this section carefully. It requires you to resolve disputes with us through individual binding arbitration and limits how you can seek relief.
Informal resolution first
Before starting any arbitration or court proceeding, you and we agree to try to resolve the dispute informally. The party raising the dispute must send a written notice describing it and the relief sought (to us at drjessemorse@gmail.com, subject line “Notice of Dispute”). If the dispute is not resolved within 60 days after the notice is received, either party may proceed as described below.
Binding individual arbitration
Except as stated below, any dispute, claim, or controversy arising out of or relating to the Site, the Content, or these Terms, including their formation, scope, enforceability, or validity, will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, before a single arbitrator. The arbitration will take place in Miami-Dade County, Florida, or by video conference if the arbitrator allows. Payment of AAA fees will be governed by the AAA rules. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act governs this section.
Exceptions
- Either party may bring an individual claim in small claims court if it qualifies.
- Either party may seek injunctive or other equitable relief in court to stop actual or threatened infringement, misappropriation, or misuse of intellectual property, name or likeness, or the Site.
- This arbitration agreement does not cover claims arising from medical care or professional services. Those claims are governed by applicable law, including Chapter 766 of the Florida Statutes, and by our Patient Agreements.
Class action and jury trial waiver
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY AWARD RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING IT. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.
If the class action waiver is found unenforceable as to any claim, that claim will be severed and decided by a court as described in “Governing law and venue,” and the rest of this section will continue to apply.
Your right to opt out
You may opt out of this arbitration agreement by emailing drjessemorse@gmail.com within 30 days after you first use the Site, with the subject line “Arbitration Opt-Out” and your name and email address. Opting out does not affect any other part of these Terms.
Governing law and venue
These Terms and any dispute relating to the Site are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida, and waive any objection based on inconvenient forum.
Suspension and termination
We may suspend, restrict, or end your access to all or part of the Site, or change or discontinue the Site, at any time and for any reason without notice or liability. Sections that by their nature should survive, including those on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, survive any termination.
Changes to these Terms
We may revise these Terms at any time by posting the updated version on this page and changing the “Last updated” date. Changes take effect when posted, and your continued use of the Site after that means you accept them. Changes to the dispute resolution section will not apply to any dispute of which we had actual notice before the change was posted.
General terms
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and Medical Disclaimer, are the entire agreement between you and us about the Site and supersede any prior understandings about it. Patient Agreements and signed engagement agreements control for the matters they cover.
- Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will stay in full effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of it.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them freely.
- Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
- No third-party beneficiaries. These Terms create no rights for any third party, except that the Morse Parties may enforce the provisions that protect them.
- Relationship. Nothing in these Terms creates a partnership, joint venture, employment, agency, or fiduciary relationship.
- Location. The Site is operated from the United States and intended for U.S. users. If you access it from elsewhere, you do so on your own initiative and are responsible for complying with local law.
- Headings. Headings are for convenience only and do not affect interpretation.
